This Privacy Policy (hereinafter “the Policy”) defines the types of personal data that PROFERTIL obtains from any User (as defined below) through the Communication Channels https://www.profertil.com.ar/ (hereinafter the “Website”) or any other communication or linking channel, or social network, or through participation in events or activities, whether in person or on-line (hereinafter the “Channels”). The Website and the Channels hereinafter individually or jointly and indistinctly, the “Communication Channels”. This Policy explains the use that PROFERTIL makes of these data, the rights it grants and honors, and the way in which it protects their security.
Access to the Communication Channels, as well as its subsequent use, implies the acceptance of the Terms and Conditions and the Privacy Policy by the Users, who by doing so declare to understand its contents. Therefore, we suggest that Users read this page carefully before accessing and/or using the Communication Channels, under their sole responsibility. Consequently, whoever does not accept the Terms and Conditions and the Privacy Policy should refrain from using them.
Terms and Conditions
These Terms and Conditions (the “T&C”) will be applied to the use of the Communication Channels owned by PROFERTIL S.A. (“PROFERTIL”) that are published at https://www.profertil.com.ar/ (hereinafter the “Website”).
The User of the Communication Channels declares that he/she knows and accepts the T&Cs from the moment he/she accesses them
For the purposes of these “T&C”, a User is any natural or legal person who, through the Communication Channels, enters information and/or data and/or interacts through them, including without limitation, whoever acquires products marketed by PROFERTIL, whether they acquire them directly or through third parties; suppliers; distributors; readers; participants in promotions or contests, visitors, clients, partners and those who in the future have the possibility of using or accessing the Communication Channels for any other reason.
The T&C represent the total agreement between the User and PROFERTIL and supersede any prior agreements that may exist between them with regard to the Website.
Should any article of the T&Cs be judicially declared unenforceable or invalid, PROFERTIL may reformulate such article, while the other articles of the T&Cs remain in force.
PROFERTIL may at any time, temporarily or permanently, terminate and/or modify the Communication Channels, without the User being entitled to any claim whatsoever.
These T&C may be modified by PROFERTIL at any time, in which case such modifications will be posted on the Communication Channels and will be the terms and conditions in effect and applicable at the time of each visit.
1. Terms of use and security of the Communication Channels.
The User agrees not to access or attempt to access the Website or use any of the services offered therein by any means other than through the web interface provided by PROFERTIL. In addition, the User agrees not to engage in any activity that interferes with, disrupts, or has the potential to interfere with or disrupt the provision of the Communication Channels services or the servers and networks connected thereto.
Users are forbidden to violate, infringe and/or in any way affect the normal use and security of the Communication Channels, including, but not limited to: (a) accessing data that is not intended for that User or logging into a computer or account that the User is not authorized to access; (b) attempting to probe, analyze or test the vulnerability of a system or network or violate security or authentication measures; c) attempting to interfere with service to any User, computer or network, including, without the following enumeration implying limitation, when done through the means of sending virus to the Website, overloading, flooding service requests or sending unsolicited mass mailing, sending malicious codes, or overriding software instructions. Violations of system or network security may result in civil or criminal liability for the User. PROFERTIL will investigate the events that may involve such violations and may become involved in cooperating with law enforcement authorities in prosecuting Users who engage in such violations.
The User agrees not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Communication Channels or any service being performed thereon. Additionally, the User undertakes not to use or attempt to use any software, tool, agent, or other device or mechanism to browse or search the Communication Channels, other than the search engines and search agents available to PROFERTIL on the Communication Channels and other than third party web browsers available to the general public (e.g., Mozilla Firefox, Internet Explorer, Opera, Google Chrome, among others). The User expressly accepts and acknowledges that a breach by the User of the above may affect the security and/or the normal development of the Communication Channels and consequently cause PROFERTIL considerable damages, including but not limited to loss of profits due to system downtime and/or decrease in sales, affectation of its brands, commercial image, loss of customers, among other serious consequences.
All the information, texts, graphics and/or the content of all the articles or publications or references to other web pages, made in the Communication Channels, are shown for illustrative purposes only, and as a reference, and may differ at the time of each visualization. In such case, PROFERTIL will not be liable for such differences, since the mentioned information is supplied without warranty of any kind, either express or implied, including but not limited to a commercial warranty.
2. Intellectual Property
PROFERTIL does not grant Users any type of license or authorization for the personal use of its intellectual property rights or any other right related to its Communication Channels and the services they offer. To this end, Users acknowledge that the reproduction, distribution, commercialization, transformation and, in general, any other form of exploitation, through any process, of all or part of the content provided by PROFERTIL is a violation of the intellectual property rights of PROFERTIL or its owner. Reproduction of any web content is strictly forbidden without the express written consent of PROFERTIL or the owners of the rights. Any unauthorized use of the information contained in the Communication Channels and any violation of the intellectual or industrial property rights will be subject to the legal responsibilities established to that effect.
The copyrights, trademarks, commercial presentations and/or other intellectual property rights contained in the Communication Channels are owned and/or licensed to PROFERTIL and are protected by the laws of the Argentine Republic and international treaties on intellectual property.
The design, programming and operation of the Communication Channels is the exclusive property of PROFERTIL and is also protected by the laws of the Republic of Argentina and international treaties on intellectual property and copyrights.
PROFERTIL and/or its suppliers and/or licensors expressly reserve all intellectual property rights and copyrights in all text, products, processes, technology, content and other materials appearing on the Communication Channels. Website access does not confer the User any license or authorization regarding any intellectual property rights or copyright of PROFERTIL and/or any third party. PROFERTIL names and logos used in the Communication Channels, including but not limited to all related product names, brand names, trademarks and/or slogans are trademarks and/or copyrights of PROFERTIL and/or third party licensors.
Therefore, the use, modification, reproduction, distribution, transmission or commercialization of the rights involved is strictly forbidden without the express written authorization from PROFERTIL except in cases of quotation rights, use for educational purposes and other recognized fair use.
3. Privacy Policy and Personal Data Protection.
We understand the protection of personal data as an opportunity of adding value to our Users. We make a responsible use of personal information and thus we protect the privacy of those who trust us with their data, allowing acting safely through the Communication Channels in our environment. As your privacy is important to us, we strive to protect it. Consequently, PROFERTIL adopted the security measures and levels of personal data protection required by the applicable law. Personal data collected through the Communication Channels may be subject to automated processing and may be stored based on PROFERTIL databases.
Processing of personal data will be entirely in accordance with the provisions of the applicable law. We commit to protect the privacy of all Communication Channel Users. On this basis, our Website does not collect the Users’ personal information, unless they provide it to us.
Should the User supply PROFERTIL with information about another person, PROFERTIL assumes that the User has obtained the corresponding authorization from the data subject for the collection and processing of the data in accordance with the terms of this Policy.
The data collected will be used by PROFERTIL exclusively for inclusion in PROFERTIL databases and to carry out the activities and/or interactions allowed by the Communication Channels.
PROFERTIL may transfer certain personal data to other PROFERTIL group companies, and/or subsidiary companies and/or shareholder companies as well as strategic partners working with PROFERTIL, to supply products or services or helping in PROFERTIL marketing activities. The User expressly agrees to the transfer of her data under these terms.
Both PROFERTIL and external service providers processing personal data on behalf of PROFERTIL may store such information on computer servers located in third countries with proper levels of protection regarding personal data protection or with contractual models authorized for this end. PROFERTIL undertakes to take the necessary steps for the best conservation and protection of this information, according to the requirements and parameters of the applicable law.
All the information and personal data entered by the User shall be the same in nature as an affidavit. PROFERTIL is not responsible for the accuracy of the personal data provided by the Users.
The holders of personal data have the right to exercise the right of access to such data free of charge, duly proving their identity for such purpose, at intervals of no less than six months, unless a legitimate interest to such effect is proven pursuant to the provisions of section 14, subsection 3 of Act No. 25,326. Likewise, when appropriate, the holders of personal data may exercise their rights of rectification and suppression of their data.
Should the applicable legislation permit or impose the deletion of data, such data will be kept for a limited period of time, and once such period expires, the personal information will be definitively deleted.
In order to exercise the rights set forth in the preceding paragraph, the holder of personal data should submit a request to PROFERTIL, either in person or remotely, by any of the following means: electronic messaging, document letter and/or written presentation with certified signature before a Bank or Notary and/or by postal or telegraphic means.
The request should include: a) Your full name and surname; b) Original or authenticated copy of your ID card or legally equivalent valid document proving your identity; c) Address; d) Zip code; e) Telephone number; f) E-mail; g) Specification of the type of right being exercised: right of access, suppression, rectification, updating or confidentiality; h) Means through which you wish to obtain the information, which may be provided in writing, by electronic, telephone or image means, or any other suitable means for such purpose, pursuant to Article 15, paragraph 3 of Act No. 25. 326; i) Your handwritten signature at the end of the request. In the event that the request is made via electronic messaging, the digital signature, if any, may be used.

The ACCESS TO PUBLIC INFORMATION AGENCY, in its capacity as Control Agency granted by Act No. 25,326, is responsible for managing complaints and claims filed by those people whose rights are affected by non-compliance with the regulations in force regarding the protection of personal data.
PROFERTIL instructs its staff to warn of possible inconsistencies or data errors, in which case they may be corrected on the spot or appropriate personnel with the proper authorization and ability to correct them will be notified.
In case of data breach, understood as such intentional or accidental incident of unauthorized access, destruction, disclosure or change of personal data PROFERTIL will take the necessary measures to solve the incident or to diminish its effects. Notwithstanding the foregoing, PROFERTIL permanently adopts preventive measures to safeguard the data it deals with.
PROFERTIL will inform the relevant supervisory authority about any non-compliance or violation that may be detected or identified, in relation to fraud, abuse or related crimes, in order to protect the security of the Users, being able in such case to use the personal information of the Users for such purposes.
4. Indemnity
Access to the Communication Channels and any use of the information contained therein is the sole responsibility of the user. PROFERTIL will not be liable for any consequences or damages that may arise from such access or use of information.
PROFERTIL will not be liable for damages caused by viruses, malicious or harmful programs in the contents and/or any other agent that may infect or affect in any way the computer system(s) used by the User.
Likewise, PROFERTIL is not responsible for the lack of availability, continuity, access, maintenance and effective operation of the Communication Channels and/or its services and/or the updating, accuracy, completeness, relevance, timeliness and/or reliability of its contents, whatever the cause, the difficulties or technical problems or of any other nature giving rise to these facts; in the same way it is not responsible for the reception, collection, storage, diffusion and/or transmission of the contents, by the Users of the Communication Channels.
Under no circumstance will PROFERTIL be responsible for the contents included in other websites property of third parties that may be connected by hypertext link to the Communication Channels as an extension of the information provided to Users, and on which PROFERTIL has no editorial control.
In the event of disputes, the laws in force in the Argentine Republic will apply and the Ordinary Courts located in the City of Buenos Aires will have jurisdiction, excluding any other jurisdiction.
5. Information and content of the Communication Channels
With regard to the information or contents that the User decides to publish or to share in the Communication Channels, the User agrees to grant PROFERTIL and its related, subsidiary or affiliated companies, a perpetual, non-exclusive, transferable, irrevocable license, without right to any compensation, to use, publish, adapt, reproduce, modify, broadcast publicly or otherwise, and distribute its content, together with its name and likes, in any media now known or hereafter invented, and for any purpose permitted by law, including advertising. The User declares that he/she is over 18 years old and assures that he/she can grant these rights and that they do not infringe the rights of a third party. The User assumes that PROFERTIL is not obligated to use this content and that it may exercise the rights granted herein by the User or make use of this content for any purpose whatsoever that PROFERTIL decides and that is permitted by law without the need for the final product to be approved by the User.
